Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement lacks lawful basis.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The case originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an mistake. After his repatriation to the United States to answer human smuggling allegations, he was detained in immigration custody.
In her order, the court pointed out that the authorities does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
Background of the Legal Challenge
The legal challenge involve conflicting claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing criminal case in Tennessee.
Conditions of Freedom
The court, who was overseeing his challenge to deportation in a Maryland district court, determined that he must now comply with the conditions of his bond from custody in Tennessee. This order shifts his monitoring to the jurisdiction handling his criminal case.
This ruling represents a notable development in a complicated legal battle featuring claims of mistaken imprisonment and disputed gang associations.
